As part of its efforts to introduce developments in the Judicial Facility, the Lawyers and Legal Advisors Committee in Asharqia Chamber organized a meeting with the President of the Personal Status Court in Dammam, Sheikh Dr. Abdul Salam bin Abdullah Al-Ghamdi, on Wednesday (23/1/2019).
The meeting discussed the terms of reference and functions of the Personal Status Court, its effects in achieving the speed of adjudication in cases and disputes and thus the achievement of justice and the protection of funds and rights.
During the meeting, Al-Ghamdi explained that the formation of the personal status courts came within the formation of the specialized courts established by the procedural system issued in 1435.
The establishment of personal status courts is a development in the judicial system due to the nature of the jurisdiction of this type of court created by judicial diversity in terms of its competence to the rights of all people and the delivery of personal rights to all members of society, which relate to their personal lives and which were previously the jurisdiction of the general courts.
He pointed out that Article (33) of the Shari'a Procedure Law clarified the jurisdiction of the personal status courts to hear all matters of personal status and the suits arising therefrom and with regard to inheritance, the division of the estate and the separation of disputes arising from the ownership of real estate, disputes of endowments and wills, in addition to the cases brought against the penalties imposed by the General Authority of the state on the funds of minors and the like.
For his part, the Chairman of Lawyers and Legal Advisors Committee, Khaled Al-Saleh, emphasized the importance of considering the legacies and the separation of them quickly in order to avoid the consequences of the delay in the division and distribution of the inheritance and liquidation, which leads to the complexity of conflict and change the value of the estate and avoid the reduction of the continuation of conflicts within the same family.
He stressed the need to put a certain controls in the selection of the custodian of the estate or the appointment of a liquidator, especially as the reality is fraught with many legal disputes arising from inheritance and related property and money and the reflection on the decline in the market value of these properties and the existence of what is known as the conflict of generations within the family.
Al-Saleh also referred to the decision issued by His Excellency the President of the Supreme Council of the Judiciary on the formation of a judicial department specialized in adjudicating disputes exceeding 100 million riyals and that this decision will expedite the termination of the division of estates and the adjudication of disputes arising therefrom, movable and cash.
Al-Saleh called for large families and commercial entities to choose a lawyer for the family to be aware of all acts of sales, gifts, wishes and partnerships, and to review all documents in order to reduce the exacerbation of intra-family disputes and ensuing legal disputes and their repercussions on the economy, given that legacies constitute large amounts of money that have a market impact.
The meeting witnessed extensive discussion on many issues related to personal issues and situations, as several developments in the judicial facility have been monitored.
At the end of the meeting, the guest speaker was honored by the Committee's chairman, lawyer Khaled Al-Saleh.
