In a lecture in the East Chamber
the General Director of the General Administration for fighting
Commercial concealment in the Ministry of Commerce and Industry, Omar bin
Mohammed has warned of the growing phenomenon of commercial concealment,
and its harms to the national security and the economy in general .. calling
for a bigger role for citizens in the fight against the phenomenon, and
eliminate them.
This came in a lecture recently given by the Eastern Chamber under the title
(harms of the commercial concealment), as he define the commercial concealment
as "enabling the non-Saudi to work for his own account on behalf of the
citizen or foreign regular investor " .. pointing that the first
article of fighting commercial concealment which was issued by a Royal Decree
No: m / 22 date: 05/04/1425 states: it is prohibited for a non-Saudi - in all
cases - to practice or invest in any activity that is not licensed to him to be
practiced or invest in it under foreign investment or other laws and
regulations system and decisions. " and he is considered- in the
application of this system – as a covering who ever enables the non-Saudi
in investing in any activity prohibited by the investment or the practice of
any activity prohibited by the practice, whether by using his name or license
or commercial record, or any other way. He mentioned some of the cases,
which are violating the concealment fighting system
among them enabling the non-Saudi of investment or practicing commercial
activity that is prohibited to be practiced, or committing brokering
or mediation, or working with a percentage, in the name of a citizen or a
foreign investor, or the Saudi covering a violating work for a certain amount,
stressing that all these cases are subjected to the sanctions that are
stipulated by the system that issued executive regulations under the Ministry
of trade and Industry decision No. 7 / m and the date 13/05/1426.Al
Suhibani stressed the danger of the phenomenon being involving deception
and violation of the regulations, because it reduces self-employment
opportunities for Saudi citizens, one of the main reasons for the rise of
unemployment, and creating unfair competition in the market, and monopolizing
some of the business activities of expatriate workers, and giving them the
chance not to work seriously with their sponsors and helping transforming
billions of riyals abroad and depriving the national economy, and thus- Based
on all of that- it is a crime.
He mentioned that the Ministry of Trade and Industry, which is
undertaking following and implementation of the regulations of the fighting
concealment system has intensified its efforts in the fight against concealment
in the current year, where 300 cases have been transmitted to the
Investigation and Prosecution Authority in the first four months of this year,
and the ministry has transmitted in the 1436 year about 290 cases of
concealment to the investigation and prosecution Authority, the portion of the
eastern region is of 58 issue, Riyadh, 47 cases, and Mecca 83 issue .. he
added, that about 380 other cases are still under the procedure, and 919 cases
are exported to the ministry, the inspection has been made for 9057 commercial establishments.
he reviewed the ministry's plan to fight the commercial concealment, the most
prominent among its items:( applying inspection campaigns on specific sectors,
and the rehabilitation and training of more inspectors, and encouraging
people to report cases of commercial concealment, and cooperating with other
relevant government agencies, and initiatives to dry up the sources of trade concealment).
stressed that the Ministry of Trade and Industry is continuing to implement its
inspection campaigns for fighting commercial concealment in various
regions of the Kingdom, where the ministry had caught number of violation
cases and applying concealment systems that reaches to two years'
imprisonment and a fine of a million riyal for the violating figure
and the eliminating of non-Saudis of the Kingdom and ending his activity
and eliminate him and canceling his commercial register, and the
prohibition of the practice of the same business for a period of up to five
years, in addition to the implementation of the regulations of defamation the
names of violators of concealment violators periodically in local
newspapers at their own expense system.. and about the citizen's role in fighting
commercial concealment. Al Suhibani stressed the importance of failure of
any citizen of the concealment and running his own business by himself,
and not to cooperate with enterprises that are working under concealment, and
