• Suspension of legal certificates upon disbursement

    Greetings,

    Asharqia Chamber presents you with its best regards, and informs you that it has received the letter of the Union of Saudi Chambers No. (45505369/1) and the date (11/18/1445 AH), which refers to the Ministry of Finance letter No. (13554) and the date (9/23/1445 AH), and out of the Ministry’s keenness To enable the private sector associated with business with the government sector and to encourage the speedy completion of work and the fulfillment of financial dues in light of the current technical linkage and development, and a reference to previous circulars issued by the Ministry of Finance, which include directing specialists in government agencies and their affiliated and associated bodies to be satisfied with the claims of companies and institutions with the required statutory certificates when Completing the procedures for disbursing the last extract only, and deducting the amounts due to the Zakat, Tax and Customs Authority or the General Organization for Social Insurance from the last extract and transferring them to the entities to which they are entitled, if upon completing the procedures for disbursing the last extract it becomes clear to the entity that the companies and institutions contracted with do not fulfill the requirements of the Zakat, Tax and Customs Authority or the Corporation. General Social Insurance, provided that companies and institutions submit a certified document proving these entitlements. As for the entitlements of companies or institutions whose disbursement is suspended due to their failure to provide proof of their commitment to the wage protection system, a portion of them will be spent to pay the late workers’ salaries, provided that those companies and institutions provide evidence proving their commitment. In the system before disbursing the remaining dues, and as it was observed that some parties continue to request such certificates.

    The Federation of Saudi Chambers confirms that companies and institutions must comply with the requirements of government agencies and commit to paying the dues of your employees and creditors. Accordingly, companies and institutions are not required to have a wage protection certificate, a zakat or tax payment certificate, or a social insurance certificate during the procedures for disbursing current or final extracts, with Emphasizing companies and institutions to adhere to the requirements of the above-mentioned certificates and consider them a legal requirement when contracting.
