The East Chamber presents its compliments, this is to inform you that we received a letter from the Council of Saudi Chambers number (ش.ق / 1247) dated (22/04/1436 e), which referred to the Minister of Labor telegram number (01/01/1508) datd (14/04/1436 ) included the reference to the Council of Ministers Resolution No. (87) dated (02/09/1436 e) to approve the transfer controls labor stalled government projects, contracts for services, and included in item (i) that the Ministry of Labor and the transfer of the troubled project workers Service (workers, technicians, supervisors) to the new contractor in the event of any need for them to services according to the guidelines, including:
- That the state bears the transfer of employment services fees
- labor agreement for the implementation of the government agency contract or Moved services to work on the project, it was not the new contractor wanting to unbearable Contractor struggling account (old).
- Movement of labor to the new contractor liking under the contracts signed between the two parties, in the case of their refusal to leave the contractor struggling account.
- To submit the new contractor to the competent labor office in support of the government agency stating its need to such employment to the Ministry of Labor take care of that need, according to the project.
- All the financial and administrative functions are subject to the new contractor for the specific requirements of Saudization, and the facility must be compliant with the requirements of the program ranges.
It includes the item (ii) of the resolution that the Saudis decades working with the contractor struggling wishing to continue to work with the new contractor to continue with the consent of the contractor struggling to be not less than wages and benefits for which they were paid unless they agree with the new contractor on the other.
Also included the item (iii) of the resolution that must prove the case of any contractor struggling workers missed work or left the kingdom or died or transfer services who recruited him already struggling under the project contract.
As the ministry has spent giving effect to the Council of Ministers' decision in item (i), to develop a process for how to transfer the troubled project labor service procedures upon receipt by the new contractor, and those include the following actions:
1. The new contractor in coordination with the government agency overseeing the troubled project, prepare a statement the names of the project labor force, and signed by the authorized employee of the government agency overseeing.
2. submit a new contractor for the Ministry of Labor and the statement referred to in paragraph (1), accompanied by an official letter from the facility this contractor includes a request for the transfer of labor to its facilities.
3. The Ministry of Labor complete technical procedures to permit the transfer of the employment service to the new contractor without the consent of the old contractor.
